INTEGRATION DYK SERIES FOR NJI PILOTS
The Did You Know (DYK) Series has been extensively utilized by NJASAP to provide informational and educational resources to its pilot groups about a number of issues. Most recently, the DYK Series was utilized to help crewmembers familiarize themselves with new provisions contained within the 2007 Collective Bargaining Agreement. In the same spirit, a DYK Series has been drafted specifically for NJI pilots to offer more detailed information about various aspects of the NJA/NJI Integration.

Do you know why NJI and NJA are merging?

NJA and NJI pilots perform the same job, serve the same owners, have the same responsibilities, and use the same support and operating structure. Because integrating the operations will provide additional career opportunities for all pilots, a process was created via LOAs during the negotiation of the 2005 Collective Bargaining Agreement to facilitate the merger of NJI and NJA. The process is intended to prevent the need to litigate the single carrier status issue or to involve the National Mediation Board.

Do you know what the last ICOM regarding NJI Integration means?

Per Letter of Agreement (LOA) 01-013, the Company has served the Union with an Initial Recognition Notice, which communicates NetJets' intent to integrate NJA and NJI per the process outlined in the LOAs. NJA and NJI will continue to operate independently until Nov. 21, 2010, or until NetJets submits a Final Integration Notice.

Do you know to what Virtual Seniority List (VSL) refers?

The Virtual Seniority List (VSL), which is is provided for in LOA 01-011, will be used to integrate the NJA and NJI seniority lists based on date-of-hire data. Currently, the VSL is used to award NJA pilots career opportunities at NJI. The VSL is and will continue to be updated and published on a quarterly basis. It will eventually be used for all situations in which seniority is a factor.

Do you know what will happen once the Final Integration Notice is sent?

No system flush or removal of pilots from their positions will take place once the final integration notice is sent.  NJI pilots will have the opportunity to take advantage of all provisions within the 2007 Collective Bargaining Agreement with the exception of the 15-Day Flex Schedule, which will not be offered to pilots who fly the Gulfstream IV or successor aircraft. No pilot will receive a reduction in pay as a result of the integration.

Do you know the potential exists for another round of Interest Based Bargaining during the course of the integration effort?

The potential for Interest-Based Bargaining (IBB) always exists. However, there are currently no plans to open the contract for collective bargaining. That said, the Union always remains open to improving members' wages and work rules.

Do you know when NJI pilots will start to receive Union benefits?

NJI pilots will not receive NJASAP benefits or be able to become active union members until the Final Integration Notice is sent. After that time, NJI pilots will be required to pay dues in accordance with the 2007 Collective Bargaining Agreement and NJASAP Bylaws at a rate of 1.5 percent of gross earnings.

Do you know what role GPAC will play in the integration?

The Gulfstream Pilot Action Committee, more commonly referred to as GPAC, was formed by NJI pilots for the benefit of NJI pilots. The committee cultivated a relationship with the NJASAP Integration Team based on a common desire to facilitate a smooth integration process in compliance with all applicable LOAs. Having met a number of their objectives, GPAC decided to conclude its efforts in January 2009. The relationships formed between NJASAP and GPAC organizers as well as other NJI pilot-liaisons has been beneficial and is expected to grow throughout the integration process.

Do you know you are not required to joint the Union, but are strongly encouraged to do so?

While no NJI pilot will be required to join the Union, he or she will work in accordance with the 2007 CBA provisions. Pilots who elect to decline NJASAP membership will be required to pay a service charge of 1.5 percent of his or her gross earnings.

Do you know the the parameters of the Gulfstream Program and Equipment locks?

An NJI crewmember who holds a position in the G-IV or a successor Gulfstream aircraft and is awarded a seniority-based vacancy in a subsequent Gulfstream aircraft will incur a thirty-six (36) month Gulfstream Equipment Lock. The Equipment Lock will run concurrently with any Gulfstream Program Lock in effect at the time of the award. 

A crewmember who is awarded a G-IV aircraft vacancy after the Final Integration Notice is sent will incur a 60-month Gulfstream Program Lock. The program lock incurred will run concurrently with the Gulfstream Equipment Lock and will prevent the crewmember for a period of sixty (60) months from bidding and being awarded a seniority-based vacancy in any aircraft other than the G-IV or a successor Gulfstream aircraft. 

NJI crewmembers will not incur a Program or Equipment Lock for their current position at the time of integration.

Do you know when you are eligible to bid the G-650 if NetJets receives them?

After the Final Integration Notice is sent and NJA and NJI are recognized as a Single Transportation System, all posted vacancies in the G-V aircraft and any successor Gulfstream aircraft, such as the G-650, will be filled based on the seniority of those crewmembers who hold positions in either the G-IV or successor Gulfstream aircraft.

Can the Union unilaterally withdraw from the Integration LOA?

No. The Collective Bargaining Agreement and accompanying Letters of Agreement are legally binding upon both the Company and the Union. The Railway Labor Act prevents either party from unilaterally withdrawing from the agreement.

Will NJI pilots be stapled onto to the bottom of the NJA seniority list?

No. Letter of Agreement 01-011 created the Virtual Seniority List, which includes all pilots on the NetJets Seniority List as well as those in the service of NetJets International. LOA 01-011 Subpart 2 states the following: “Pilots will be placed on the VSL based on their date of hire by their respective companies. All pilots covered by the NetJets/IBT pilot collective bargaining agreement (including NetJets pilots who moved to NJI under the terms of LOA 01-003) will be placed on the VSL based on their date of hire by NetJets. All pilots in the service of NJI will be placed on the VSL based on their date of hire by NJI.” The LOA is binding and the Union and Company will abide by its terms.

Will I have to join the Union?

State right-to-work laws are preempted by the federal Railway Labor Act, which has no such provision and renders such state laws inapplicable. However, NJASAP has negotiated an Agency Shop Agreement at NetJets which allows a pilot to choose to become a fee payer rather than a Union member. Although both members and fee payers remit 1.5 percent of their gross wages to NJASAP, fee payers do not enjoy the benefits of Union membership.

Will NJI pilots receive holiday, overtime, after midnight and SDP pay?

Once the Company sends the Final Integration Notice or Nov. 21, 2010, whichever is earlier, holiday pay, overtime, after midnight and supplemental duty position pay provisions of the 2007 Collective Bargaining Agreement (CBA) will apply to NJI pilots.

: Pilots who work those holidays listed in 2007 CBA Section 27.2(D)(1) will receive holiday pay, which is one-and-a-half times a pilot’s normal daily rate.

: This compensation is paid on any duty day that exceeds 12 hours of duty as well as on the first day of a tour in which duty begins before 08:00am local. The rate is calculated by dividing a pilot’s annual base wage by 2,184 and multiplying that number by 1.5; hourly overtime is paid in quarter hours. spcr

: A pilot who arrives at his base after midnight on the last day of his or her tour will receive pay for two extended days.

How are vacations handled by the CBA?

According to the 2007 CBA, pilots accrue vacation based on years of service. A pilot who has completed one to four years of service is entitled to two weeks of vacation; five to nine years, three weeks; and 10 or more years, four weeks. Vacations are bid annually and are awarded based on seniority within seat and fleet; the vacation year runs from Oct. 1 to Sept. 30. Pilots may elect to sell back a portion of their vacation; however, that election must be made prior to accruing those days. If a pilot has unused vacation at the time he or she decides to separate from the Company, the days will be paid to the pilot.

Will NJI pilots have access to the PTO System created by the 2007 CBA?

The Paid Time Off (PTO) System was established by Section 10 of the 2007 Basic Agreement and will apply to all NJI pilots after the Final Integration Notice is served, or Nov. 21, 2010, whichever is earlier. Paid Time Off may be used as personal or sick days: Personal days must be bid and awarded prior to use while sick days may be used when an injury or illness prevents a pilot from performing flight duty. In select instances, some unused PTO days may be sold back at the year’s end; however, the specifics of implementing the program at NJI have not been fully established. Once they are finalized, the protocol will be communicated to all pilots.

How was seniority on the VSL determined?

The Virtual Seniority List (VSL), which was created by LOA 01-011, describes how VSL seniority was established. In short, each pilot was placed on the VSL by date of hire at his or her respective company. A 30-day period is observed immediately following each quarterly VSL publication, giving NJA and NJI pilots the opportunity to formally protest their placement on the list. Once the integration is complete, the VSL will become the NetJets, Inc., Pilot Seniority List and used as sole guidance for all instances in which seniority is factor at NJA/NJI/NJLA.

Did you know the Contract codifies crew rest provisions?

Section 28 of the 2007 Collective Bargaining Agreement (CBA) establishes crew rest provisions. While those provisions generally mirror those requirements stipulated by Federal Aviation Regulations, in some instances the contract’s rest rules are more restrictive. For example, Section 28 requires the Company to give a pilot 14 hours of rest prior to assigning flight duty that will cross four or more time zones. Additionally, provisions exist that allow pilots who are too tired to safely operate their airplane to “call fatigued” thereby ending a duty assignment or extending their rest period without penalty. Such provisions ensure all crewmembers are adequately rested for their flight assignments.

Do you know how to report a violation of the Agreement?

The Company, as a rule, complies with the Contract. From time to time, however, a violation occurs. When such a violation only harms the individual pilot, he or she may, in accordance with CBA § 21, file a grievance; grievance forms are available on the Online Forms page of the NJASAP Web site. If the violation could affect the entire pilot group, the pilot should contact the NJASAP Stewards Council via e-mail, stewards@njasap.com. In those particular instances, the Union may elect to file a class action grievance on behalf of all affected Union members.

Indeed, each volunteer plays an important role in the day-to-day operation of the Association’s 24 active committees, which are listed on the next page.
